ACA reporting rules pose challenges for employers

Employers with 50 or more full-time-equivalent employees are still waiting for final word from the Internal Revenue Service about the annual forms they will be required to file with the government under the Affordable Care Act.

The IRS issued draft forms last summer spelling out the information covered employers will need to provide to the tax agency and employees, and in what format, but hasn’t yet finalized the forms or instructions.

The agency also hasn’t issued the technical specifications that employers need to fully build and program their systems to track and report new ACA-required data.

Covered employers must file the first forms and statements in early 2016, based on data tracked in 2015. The information is required under two new federal tax code sections:

The NRA, as part of the Employers for Flexibility in Health Care (E-FLEX) coalition, filed comments last fall asking the IRS to streamline the forms and finalize the documents quickly, so employers can set up their systems.
