Statement on Equal Employment Opportunity v. Texas Roadhouse Inc. Decision

Washington, D.C. — Today, the Restaurant Law Center issued the following statement after the Equal Employment Opportunity Commission’s (EEOC) age bias case against Texas Roadhouse ended in a mistrial. The jury in Boston said three times that it could not come to a unanimous decision:

“The restaurant industry supports maintaining a bias-free workplace.  We welcome today’s ruling on the EEOC’s questionable enforcement practices. We urge them to stop these practices and instead deal with the current backlog of age discrimination complaints.” - Angelo Amador, Executive Director of the Restaurant Law Center

BACKGROUND:

In 2015, the National Restaurant Association testified to the U.S. Senate Committee on Health, Education, Labor and Pensions on oversight of the EEOC’s enforcement and litigation programs. The testimony cited actions by the EEOC, under the last Administration, to seek out unsubstantiated bias cases rather than deal with the tens of thousands of complaints they receive.  The EEOC was investigating companies even when no complaint had been filed against them.
