NRA comments on new health care requirements

The National Restaurant Association asked the U.S. Department of Health and Human Services to consider delaying a provision of the health care law set to take effect next March.

The provision requires employers who offer health insurance to provide employees with information about health care plans in a new format starting March 23, 2012. HHS is charged with giving employers a new template to use as a "Summary of Benefits and Coverage," along with a glossary of terms and certain other materials. The agency in July released proposed regulations and templates to implement this part of the 2010 health care law.

In comments filed with HHS on the proposed regulations, the National Restaurant Association asked that employers be given more time to comply.

"Our goal is to provide our employees and their families with clear, useful information about their medical plan options to make informed decisions. While we agree with the intent of the proposed regulation, we are concerned about the timing of the implementation of this rule and the potential confusion that some of the proposals may create for employees," the NRA wrote, asking for an additional 18 to 24 months for compliance.

The Association also asked HHS to look at the total administrative burden the 2010 health care law will impose on employers, rather than considering each new requirement separately. "These Summary of Benefits and Coverage requirements must be considered in the context and continuum of the other requirements the law will place on employers."
