New H-2B visa rules take effect April 23

The Department of Labor last month issued final regulations that change the rules for employers who use the H-2B program.

H-2B visas are designed to help seasonal businesses hire temporary employees from outside the United States when they can't find employees domestically. Resort-area restaurants are among the biggest users of the program.

The National Restaurant Association argued in comments filed with DOL last May that the bureaucratic new rules could effectively kill the H-2B program for restaurateurs by making the program nearly impossible to use. However, the DOL went ahead and finalized the regulations with few changes. Unless a court intervenes, the rules are scheduled to take effect April 23.
